1. Acceptance
By accessing Second Point (the "Site") or subscribing to any Second Point publication (collectively, the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Landon Johnson, a sole proprietor doing business as Second Point ("we," "us"), based in Indiana, USA.
2. Nature of the Service; No Advisory Relationship
Second Point is a publisher of general market commentary and research provided for informational and educational purposes only. The Service does not constitute investment advice, a recommendation, or a solicitation, is not personalized to any subscriber, and creates no fiduciary, advisory, brokerage, or professional relationship. We are not a registered investment adviser or broker-dealer. See our Investment Disclaimer, which is incorporated by reference.
3. Eligibility
You must be at least 18 and able to form a binding contract.
4. Subscriptions and Payment
The Second Point newsletter is currently free. If and when paid subscriptions are offered, they will be billed through our publishing platform (Substack) at a flat subscription price for access to published content, and fees will not be contingent on any subscriber's trading activity, assets, or investment performance. Paid subscriptions would renew automatically until canceled; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law.
5. Intellectual Property
All content is owned by Landon Johnson (doing business as Second Point) or licensed from third parties, and is protected by copyright. Your subscription grants a personal, non-transferable, non-exclusive license to access the content for your own use. You may not republish, redistribute, resell, or share paywalled content without prior written permission.
6. Acceptable Use
You will not share subscriber credentials, scrape the Site, or use the Service to violate any law.
7. No Warranties
The Service is provided "as is" and "as available," without warranties of any kind. We do not warrant that any content is accurate, complete, current, or error-free, or that any thesis or forecast will prove correct.
8. Limitation of Liability
To the maximum extent permitted by law, Landon Johnson (doing business as Second Point), and any contributor to the Service, will not be liable for any investment losses or for any indirect, incidental, consequential, or punitive damages arising from your use of the Service or reliance on any content. Our total aggregate liability for any claim will not exceed the amount you paid us in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify us against claims arising from your misuse of the Service or violation of these Terms.
10. Governing Law and Disputes

11. Changes
